Hello,
I ordered a camera on Cdiscount in August 2005. The total came to €150 with a 3x payment plan without fees, the first payment of €50 having been debited at the time of the order. However, the quality of the camera was really not great, so I returned the product to Cdiscount asking for a refund. Usually, I always have issues with them regarding delays, but this time everything went smoothly. Since the second payment had already gone through, they refunded me the first two payments and canceled the third one: everything was fine in the best of worlds. However, a few days ago, 3 years later, they are demanding payment for the third installment!!! And they're doing this with threats of collection (via email and SMS). I categorically refuse to call their premium rate number as I’ve tested that once: €10 phone bill for someone who speaks very poorly in French to read me canned phrases and not answer my questions! So I wrote a letter with the return receipts for the product, the refund, and the cancellation of the last payment... I have received no response from them, but on the other hand, the collection emails and SMS keep pouring in...
Three questions arise:
- I understand that there may be technical issues, but is it legal to demand money (that I do not owe...) 3 years later?
- Is it legal to send collection notices via SMS and email? I thought this had to be done by mail (registered letter?)
- How can I make them understand that I do not owe them this money!!!
Do you have any advice for me?
Thank you in advance!

Here is my case,
After a purchase on Cdiscount amounting to €480...
The product arrives at my home after about ten days....
Upon receipt, I notice that the package is somewhat wet (the cardboard) and that "The Product" does not suit me!
The next day, I call Cdiscount's after-sales service, asserting my right to return the product within 7 days!
The person confirms that they are taking my request into account and assigns it to my file, clearly stating that I will be contacted by the carrier within a maximum of 4 days.
Four days pass, I call the carrier, who tells me they can't do anything without the "Return Slip" from Cdiscount, which I promptly call back via 3979 (premium rate)
Two days of calls and clarifications with their services (I won't even mention my phone bill), during which there was one day in particular: they transferred me from one service to another, speaking with 6 representatives, including one twice in a row...
I confirmed to her that I called the day after my receipt, and since she spoke poor French, she only confirmed the correct product that I had purchased, and if there was to be a return of merchandise, it would be at my expense... which I ultimately accepted....
After searching for a carrier to find one in my area (city) to make the return, I find no one within my tight budget!
Their terms state my bank opposition (4 payment attempts) and finding no carrier to fit my strict budget!
Having taken the first payment already, and the second possibly not being deducted, they contacted me with their debt collection service, stating that I need to pay the remaining amount: €360
So, my question is,
Are they entitled to withdraw this amount from my bank account?
Am I within my rights to refuse to pay?
Thank you for your responses...

I purchased from Cdiscount, with payment in 4 installments that included fees. The first payment went smoothly, but then I changed my credit card and forgot to inform them. Furthermore, I thought the second payment had been made since I didn't receive any "unpaid" email. Today they want me to pay back the total amount of the product while I wasn't aware that I had an unpaid invoice. Additionally, there are fees with the 4 installment payment plan.
What can I do to stop this total payment? I can't afford it.
Thank you.
Which of course I paid (3x with fees at the time). So I called them after desperately trying to access my old email account where I had stored the payment receipts, but the email address has been deleted! So from my side, I know I paid, what should I do?
Supposedly for the past 2 years they have been looking for me regarding these "88 euros" while I order from them every month with the same credit card, the woman responds that it's impossible for me to have ordered since 2013 (with her really good French I admit).
How can I prove that I paid if I no longer have access to my receipts?
