Hello
At the beginning of November, I ordered a phone online for Christmas. It never arrived, so I was refunded and bought another phone. And today, two and a half months later, the phone has arrived.
I paid a certain amount to receive my package within the time indicated by the seller. He did not respect his part of the contract, so I consider that I owe him nothing, and on top of that, I bought a new phone in the meantime. If I have to refund him, it will cost me a lot, and I am not at fault for this delay of two and a half months. What do you advise me to do? Is there a risk if I do not notify him?

Hello;

If the purchase has been refunded by the seller, I advise you to get back in touch with him to obtain a return label to send the merchandise back to him; otherwise, he may very well ask you for payment for his supply if you keep it!

As mentioned above, why not send a message to your seller to let him know that you received his shipment 2 and a half months later, despite the refund he gave you, which is very honest of him, and play fair on your side >> Keep a copy of the email sent as well as the merchandise and wait for a reaction from the seller; otherwise, you risk coming across as someone "dishonest."

That's what I would personally do; otherwise, the supplier has the right to claim payment for his supply.....

  I'm not sure if it's the seller who refunded me or maybe Priceminister. Do you know what I risk if I let it go? Worst case scenario, what could happen, I just refund him nothing more? Thanks to him, I ended up empty-handed at Christmas. If you think there's no major risk, I'd prefer to let it go and refund or return the item if he contacts me again. What do you think?

  The only risk you have is paying for the merchandise because I assume there must be a record of the delivery and your account might just get charged if the seller has your bank details!
  But since we’re reiterating, why not do as mentioned above and wait for the seller's response?

  Simply because I prefer to keep the phone, the seller wasn't fair, he kind of spoiled my Christmas, I don't want to refund him or send it back to China, it would be complicated and there would be another month of waiting. If he contacts me, I will discuss it with him. I just wanted to know if I risk anything serious.
