Duration of unpaid filing with telephone operators

Hi, I'm in the same situation. Even after a 6-year period with preventel, I'm still on preventel. So what they're saying is false. I was told that I just had to wait either 2 or 5 years, and once your file is settled, you have to pay a guarantee for about a year and then they reimburse you if all invoices are paid. But I don't really believe in the reimbursement. Anyway. To answer the other question, you can always ask a friend or family member to open the line for you, and as soon as you get the first invoice, you can change their bank account information to yours.

It's 3 years in the case of a single infraction (unpaid) and 5 years in the case of multiple infractions (unpaid, fraud to obtain a line ...), after which the operator becomes liable (even if the debt has not been settled, as Micky30 said).

Excerpt from article 226-20 of the penal code:

The act of retaining personal data beyond the duration set by law or regulation, by request for authorization or advice, or by prior declaration addressed to the National Commission for Computing and Liberties, is punishable by five years imprisonment and a fine of 300,000 Euros, unless this retention is carried out for historical, statistical or scientific purposes under the conditions provided by law.

The same penalties apply to the act, except in cases provided by law, of processing for purposes other than historical, statistical or scientific those personal data retained beyond the duration mentioned in the first paragraph.

So if you are still listed after the legally authorized period, you simply need to send a nice little letter of formal notice reminding them of the law and summoning them to remove you from the list within 72 hours of receipt of the letter + copy to the CNIL. Otherwise, file a complaint with the CNIL / local judge (declaration at the registry is free).

Rest assured, you won't get to that point because you will be removed within 72 hours ;-). (unless you've sent your letter to the wrong address).
