Package marked as "delivered," never received — AliExpress refuses to re

I ordered a smartphone from the MI 1 Store on AliExpress (order no. 3054416827798934), shipped by Colissimo. The package is marked as "delivered" on July 17, 2025, but I never received it.
I have taken all possible steps with La Poste and AliExpress customer service.
• Several claims
• Filing a complaint for theft or diversion
• Sworn statement of non-receipt of the package
• Request for an official certificate of non-receipt (no response)
Despite all this, AliExpress refuses to refund me or resend the item, on the grounds that they need an official certificate of non-receipt, which La Poste refuses to provide since the shipment was made without signature upon delivery.
This is the real problem: the seller chose a delivery method without signature, without my consent,
According to Article L.216-4 of the Consumer Code, it is the seller who must assume the risks related to transportation, not the customer.
Despite my explanations, AliExpress completely shirks responsibility and leaves the buyer to fend for themselves, even in the face of clear theft.
I strongly advise against ordering on AliExpress for high-value products, especially when they are sent without a signature. In case of loss or theft, you will have no protection, even if you prove your good faith.
This is a very disappointing and unfair experience.

MI stores are opening in France, which would probably be more convenient for order tracking and inquiries as it's their local network if you are in France, for example.
Aliexpress, a huge and distant mail-order platform, manages so many listings from different suppliers of all kinds that it does not take responsibility for their errors if the sale is not guaranteed by a contract directly on the platform like many others. In other cases, there is hardly any recourse possible, sometimes no existing regulatory structures or agreements binding between the sender, often an independent producer, the delivery country, the customer, and sometimes even the seller's country.

If it's a Colissimo, the last step where the package is scanned is at delivery by the delivery person. With or without a signature, it gets scanned.
You can track it on the La Poste website, which gives you an indication about the package's drop-off (handed to a third party, in a mailbox, etc.).
AliExpress relies on this information. If the package was stolen or disappeared after this last step, all you can do is file a complaint.
As you said, it's best to avoid buying valuable items when the seller sends them without guarantee. Colissimo is very basic; using registered mail with a signature would have been wiser, but for the seller, if there's tracking, that's enough to prove it was delivered.
