Spartoo package delivered but not received

Hello, the tracking for my Spartoo package indicates that it has been delivered, but I haven't received it. I have contacted customer service, and they are asking me to file a complaint for theft of the package, but I would prefer not to do so, and they refuse to refund me. What can I do?
