Hello,
FREE Telecom has validated 2 subscriptions for my address, so I received 2 Freeboxes and naturally, I returned one to cancel one of the subscriptions.
They then demanded the cancellation fees: €90 + 1 month that I did not pay, as I was not going to pay for 2 subscriptions...
This issue dates back to November 2007.
Since then, they have followed up with me, and on my end, I have sent them letters, messages on www.assistancefree.fr, etc...
I have all the proof of the various exchanged messages and their mistake, but they are persisting in their collection process.
Yesterday, I received a letter from a bailiff threatening legal action + seizure from my account if I do not pay within 48 hours. The amount is now €134.
I do not wish to pay this amount, but as a result, I have 2 questions:
- has anyone ever had this problem with 2 subscriptions with Free? Who should I contact to make them understand their mistake?
- has anyone gone as far as litigation with Free or any other operator, and how does it go? I really don’t have time to go to court or wherever...
Once again, the consumer (me in this example) is always put in a difficult situation, whether it's their fault or not...
Thank you for your help!
Adrien

I am a lawyer and I assert that all the seizure threats sent by mail by bailiffs, at the request of modern service providers (telephony, ADSL, CABLE, etc....) are FAKE!
And this is simply because THESE PROCEEDINGS ARE CARRIED OUT WITHOUT ANY COURT JUDGMENT! So you can sleep easy if you don't pay!
Moreover, these providers know very well that if they brought their dispute before a court, they would lose their case because it is enough for the client to state that the mobile phone, the ADSL modem, the cable, or the decoder were not working or were malfunctioning most of the time for the client to win the case and additionally obtain damages for abusive procedure!
Stop letting yourself be intimidated! The only way to blow up this rotten system to its core would be for consumers to stop being taken for fools and STAND TOGETHER! (for example by abstaining from watching TV for 3 days) But let's not dream! I don’t mean to be harsh, but when we remember who they voted for in the presidential elections, then we can understand that they like to get screwed from all sides!
A word to the wise, goodbye!

I went to see UFC Que Choisir in my department and everything was settled; they canceled my bill and I haven't heard from them since.
Good luck and don't let yourself be pushed around, especially.
I sent my cancellation via registered mail, returned the Free box also via registered mail, and now they are demanding 24 euros through a collection agency. Since I don't want to pay this amount knowing that it was them who caused us frustration with faulty equipment, I wanted your advice on potential bailiffs and the steps to take.
Since then, I switched to Orange and my phone equipment is still the same.... and it's working very well.
Thank you
