Hello,
Hello, I received a 230 euro Micromania gift card for Christmas with the intention of buying a PS5. As if this console isn't hard enough to find, this store finds nothing better than to sell it in bundles starting at 540 euros, which doesn’t interest me. I asked to buy a standalone digital console that was included in a 1600 euro TV bundle (this is not a joke), but my request was denied as the bundles are non-separable. I then requested a refund for my two gift cards in order to buy my console at Fnac, where I know the manager... impossible according to the terms and conditions which my son never signed before the purchase. Knowing that 47 of their stores are set to close, I think this signals the end of this chain. How can I either obtain a digital console or get a refund for the amount of my gift cards?
I find this method abusive. Why not sell the console in a "washing machine" bundle... to me this is forced selling and I fully intend to take action against them.
Can you please provide me with the procedure to follow because I am very angry about this sales method!!!

Hello,
Regarding the terms and conditions, your son accepted them when he made a purchase there... There is no need to sign anything (just like when you go grocery shopping, you don't sign anything at each checkout... yet you agreed to the terms and conditions)
Regarding the sale of Micromania packs, they have been criticized for a long time, but there isn't much you can do about it... it's not a sale, no one is forcing you to buy the pack.
Furthermore, there are times (just like everywhere) when the console is again available for purchase and back in stock.
To conquer without peril is to triumph without glory.

Good luck!

Hello,
Indeed, it's important to check the terms of sale (which, if I remember correctly, are also printed on the back of these gift cards). Technically, this gift card is not only meant for purchasing a PS5, but for any item available in a Micromania store.
Their difficulty? None. Just a loss of money as you pointed out. Furthermore, you don't plan to buy from them, so they are losing no customers. The availability of the console is not exclusive to Micromania, but applies to all retail outlets.

Good evening, no, just the opposite, if the general terms and conditions had been written on the card or in the store, I wouldn't be contesting the decision of Micromania in Nice. I think you didn't understand; I was indeed planning to buy from them, but when I went to get information in-store, I was told they didn't know when they would restock, that I should keep an eye on the website (as if I had nothing else to do with my days?) or better yet... that I should look for something else in their store (that's quite a sales policy)!
I know full well that availability applies to all retailers, even though... I know one that restocked every Thursday, and I work with two big stores which my son didn’t know about.
I will wait until September to try and get one, and if I can't, I will reach out to a well-known organization to try to get a favorable outcome.
Thank you.

Hello,
After some research:
Regarding the GTC, your son accepted them when buying as I told you.
This argument is not very convincing since it is possible to set alerts on their site and thus know the stock availability.
Their argument about buying something else is valid... and they are totally right... Given the validity of gift cards, if the PS5 is not restocked you will have to use it differently.
In the GTC
It's a shame your son didn't get a gift card from these retailers...
Good luck with that. Keep us updated if you were successful.
After some research:
1.4 Acceptance of the GTC
1.4.1 The Client acknowledges having read the GTC prior to any purchase and declares to
accept them in their entirety.

1.4.2 The GTC are freely accessible to the Client in the Store. Furthermore, they are
communicated without delay to any Client who requests them in the Store in paper and/or
electronic version, according to their choice.

I had to monitor the site (as if I had nothing else to do with my days?)

In the GTC
A gift card cannot be refunded, all sales being final.
I know very well that availability is an issue for all retailers, although... I know one that received stock every Thursday and I work with two large retailers that my son was not aware of.

None, I'm just used to people who don't bother reading the Terms and Conditions available online or who just want to complain about everything (like you, which is fine, you may actually have a real grievance).
And as stated in the Terms and Conditions (once again, it’s strange), your son accepted the Terms and Conditions by making a purchase. He could have very well checked online, as he could have asked whether the PS5 in the bundles could be sold separately or about stock replenishment frequency.
That's exactly it. You can't do anything about the fact that they have no stock. Moreover, I even think that their stock for the bundles has also been depleted and that these bundles are just reservations (and not directly available for pickup in store).
You can perfectly get prepaid PlayStation Store cards, for example. (valid for 1 year as far as I remember) for your future digital game versions.
It's great if you've had victories in your claims for failures. But in this case, there’s absolutely none.
You're getting tricked... quickly, you have 2xx euros in gift cards to spend freely with them.

None of the two, if you want legal specialists, it's with our neighbors:

Unfortunately, that's reality... If I’m offered a gift card of 200 euros at "Makeup and Beauty" ... Too bad, I’ll try to find someone to buy my card.
It's not really the politics that cause them to close, but anyway, that's not the point.
