Hello,
I sold a kerosene heater on leboncoin 5 days ago, a heater that was working properly, and the person who bought it from me says there is an error message when she starts it, a message suggesting maintenance.
This person (who had me lower the price by €30) wants to return the heater and is asking for a refund.
I really don't want to refund this person at all, especially since I don't know what she has done with the heater since!
I would like some advice.

    A private sale is final. No warranty to provide.

    Let them complain, the buyer has no recourse even if the tone escalates. Furthermore, we don't know what they did with the stove..

    Let the buyer take care of it themselves if this message really appears.

      Recurring problem.. We buy and then we regret. So we invoke a 'breakdown' (Imaginary or - worse - caused..).

      Don't give in, legally you don't have to take back the stove.. But some stubborn people insist, invoking 'hidden defects' to scare us.. Haha!
      Once we understand what the procedure regarding 'hidden defects' entails, we give up, more than discouraged!

      Hello,
      The buyer is insisting, I told him that my daughter-in-law, who is a lawyer, advised me (it’s a lie, but he doesn’t know) not to take back the stove because it was a second-hand item sold as is and we didn’t know if he had used it correctly.
      He referred me to article 1641 of the civil code and is insisting on coming to my house.

      Article L1641 of the Civil Code addresses 'hidden defects'...

      If your buyer wants to use this Article, he will have to go to court, hire a lawyer, and pay an expert in stoves approved by the court.. Long, costly.. And most certainly not justified by the amount at stake. His speech is only meant to scare and recover the investment..

      What is the rough amount?

      Thank you for your response, especially on a Sunday.
      I had put the stove up for sale at €150 and he asked me via text to lower it to €120, which I accepted, then he said that if he picked it up the same day (last Sunday) he could only give me €100. At that moment, I told him we were stopping the negotiations right away, then he said that he had finally found the €20 but that he would only come on Monday because blablabla...
      He did indeed come last Monday at 1:30 PM as agreed, with a great car, pulled out a wad of cash, and asked me if I preferred a €100 note or two €50 notes !!!!
      It's a stove that sells in stores for around €300 !!
      All this to say that I sold this stove for €120!!!

    If the defect is mentioned in the ad, no complaints, otherwise it's a scam!

    Unless it’s noted in the ad, and regardless of the price, when you buy it, the minimum is that it works!!!!

      Hmm... possible, but also possible that the buyer damaged the item through misuse or (worse) intentionally to have it returned under the pretext of a dispute...

      In short, that's the whole issue with private sales... where nothing proves anything and vice versa...
