Court decision regarding a similar issue:

Article L 121-20 of the Consumer Code allows the buyer to exercise a right of withdrawal for sales concluded remotely, particularly through e-commerce.

It follows from the provisions of Article L. 121-16 of the Consumer Code that this right of withdrawal only applies to distance sales contracts concluded between a private consumer and a professional seller.

The disputed transaction was made between private individuals, therefore the buyer will not be able to benefit from the right of withdrawal.
