after being approached by phone, I signed a website creation contract that commits me for 48 months; After wanting to terminate this contract which has not yet been finalized (I sent a registered letter to terminate it) and I tried to discuss with the saleswoman and the head office: without success...

I would like to react to this topic where I too often find myself as a spectator.

I work in SEO, website creation, etc... and I'm happy to read that some clients are stepping in to denounce these unbearable and unacceptable actions regarding the sale of websites presented in the form of a “LOA” (like for cars) but with the difference that this type of contract is designed to "trap" the client if they ever think of leaving the concerned service provider.

Indeed, it is unthinkable nowadays to imagine that a website could be sold under the conditions noted below, such as the lack of communication of access codes, charging monthly fees for durations that can reach 72 months (as I have heard from some of my clients).

After all, who would leave a serious, professional service provider that they are satisfied with???

If I can give a few tips:
- Check in the terms of the contract that the website belongs to you (which implies the communication of access codes..)
- You own your domain name.
- The website must be paid in full (excluding payment terms to negotiate 50/50 etc...)
- Don’t hesitate to get different quotes and compare.
- The largest companies are unfortunately not always the most reliable.
- Make sure you have a single contact person who will handle your case.
- Remember that on the internet, borders no longer exist, so don’t hesitate to look beyond your department.

In this case, I don't think you are covered by the laws on door-to-door sales or mail order sales as an individual. (I am not a lawyer and do not know the specifics of EARLs compared to SARLs or EURLs).

This is a commercial contract and unless you can demonstrate that it is fraudulent, there is nothing you can do.

The following very questionable practice is now widespread:
- Charging a very low setup fee (often sold at a loss) of either €200 or €300
- Charging a very high monthly subscription fee of €200 to €500 when market prices are much lower.
- Never giving the access code to the client; any changes to your site must go through them at friend prices (I'd like to have friends like that).
- Over 4 years, the client will have paid three or four times more than necessary. I don't know if this can be considered as fraud.

I sometimes undertake this type of work, and I have to demonstrate to my clients that these offers are not attractive, but they are becoming increasingly numerous.

One of my friends feels cheated by Geolid, so I took a look at the contract.
Nothing to criticize, it's well locked down! However, it should be noted that there is a price that could be considered excessive and unspecified services!

1st option… terminating the contract.
If you signed as a professional, consumer protection laws do not protect you since you are a "pro" and are supposed to know your trade.
However, it should be noted that the judge has sometimes granted professionals the protection due to consumers, especially in cases of private purchases but also when it involves areas they are not capable of mastering. A butcher cannot benefit from protection when buying his meat because he clearly knows that field, but not when it comes to a computer purchase.
This is a first option that you may not be able to utilize given the imposed deadlines.

2nd option… resistance.
You have signed a contract that provides for, on the one hand, the creation of a website and, on the other hand, the sale of advertising.
The company Geolid seems to forget the famous law that gives hives to advertising agencies, I’m talking about the Sapin Law. What a nice Christmas gift for Geolid!
The law no 93-122 of January 29, 1993, known as the Sapin Law relating to the prevention of corruption and the transparency of economic life was tailor-made for us: it limits media agencies by prohibiting them from accumulating purchases of their clients' advertising spaces.
Although predating the Internet, the Paris Court of Appeal has considered that a contract between an advertising client and an advertising agency tasked with purchasing online advertising banners is governed by the provisions of articles 20 to 28 of the law of January 29, 1993.

In practice: This concerns all activities related to paid referencing whether on a search engine or on a website or a directory, and not the task of creating a website.
In terms of advertising service, Geolid has an obligation to report: under common law, an obligation to inform the principal of the fulfillment of its mission and to return to that principal the sums received under its power of attorney.
The seller of advertising space, as a support or management entity, must report directly to the advertiser, within a month of the advertisement being broadcast, on the conditions under which the services were carried out. He must also report to the advertiser on any modifications that have occurred.

Article 20 of the law has set the content of the mandate contract. It must mention the conditions of remuneration of the mandate holder with a breakdown of services which is not the case for Geolid.

What can be said about a contract that does not comply with the obligations of the law? Ask your lawyer!
In the meantime, dispute Geolid's invoices if you have not received the details of the services.

I just made the same mistake.
With the Sitti group,
signed yesterday I called the same day and then I sent the cancellation letter today (no payment or bank account information in their possession).

The sales representative told me to send the letter to the address provided without any further details. Upon rereading the contract, I realize that if I want to cancel, I owe them 800 euros (for nothing!!!).

I think I understand that they are within their rights and that the law supports them anyway???!!!!!!!!!!!

I don't understand,
with all these companies taking advantage of small businesses, why doesn’t the justice system do anything to defend us against these methods that are so well constructed that they are carried out under the very cover of the law?

Can I have grounds for an appeal for breach of trust? I doubt it, but still...

I signed a 48-month contract with BeUp for my website creation and SEO.
I want to terminate this contract because after receiving my monthly statistics and taking the time to look at them properly, I noticed there were calls logged in the call tracking that never came to my phone.
I contacted them for an explanation, and after checking, it turns out that these idiots had incorrectly transcribed the mobile number I provided them.
My site has been live for 2 months with the wrong number, so all my potential clients ended up calling an invalid number.

Ordering from a Belgian company is not an issue.
Unfortunately, there are bad apples in every country.
If you work with a Belgian company, you have guarantees, but you need to know this:

I see that I am unfortunately not the only one.

Following a phone solicitation, last Friday I was tempted by the enticing offer for creating a website. Big mistake: I signed.
Then over the weekend after some research on the Sitti / Cybbel group, I preferred to cancel the terms I signed on Friday at noon.
So on Monday (3 days after the signing day) I sent a cancellation letter via registered mail and emailed a copy of that letter.
The sales representative called me to inform me that the technical services had already started creating my site! (Do these nice people work on the weekend???) So she informed me that I would receive the invoice regarding logo creation and website creation (2 elements that I obviously did not validate).

Unfortunately, after research, there is no withdrawal period between professionals. It is undoubtedly a legal loophole that SITTI is taking advantage of, which I consider to be in bad faith.

I will initiate a procedure with the legal assistance of my insurance.

What to remember: DO NOT SIGN QUICKLY! Take the time to reflect and analyze despite the enticing offer proposed by their unscrupulous sales representatives!
