Good evening, I had the idea of buying items on Catawiki to try to resell them for a small profit.
I was horrified by the first two items received and I've lost money.
Now there’s an item worth 650 E, I relied on the photo which was enlarged and instead of a stone I received a chip.
The seller is ghosting me and Catawiki doesn’t care...
I also refused to receive and pay for the rest, they are adding astronomical fees and bailiffs and lawsuits….
Has anyone had experience with them, as apparently I would be subject to Dutch jurisdiction? I don’t know how to get out of this, as I’ve read in the forums that they were selling fakes and harassing people.
I consulted with an expert at the Paris court who told me that one cannot actually assess the value of a piece of jewelry solely from a photo, and that it was at my own risk.
Has anyone had a legal dispute with this site because on a jewelry piece worth 240 E that I didn’t take, they are demanding just as many fees.
And there are many others because I used my savings to create a job while waiting for something more lucrative.
I’ve been taken for a ride but I feel like I’m not at the end of my troubles. Thank you for helping me by sharing your experiences on this site and any advice would be welcome.

To those who might be interested, they are legally not allowed to demand payment plus additional fees since you benefit from a right of withdrawal (and it would simply be foolish to pay to receive it and then return it immediately while claiming a refund). Moreover, you do not own the item for which they demand payment, while they themselves are not the owners; they are just making money as intermediaries and would only have the right to feel aggrieved by the few euros representing their 9%... In short, the people who refuse to pay are merely an opportunity for them to possibly earn a more interesting bonus than their percentage, by demanding more money and hoping that the threat will make them pay the price plus the extra... Not to mention that collection agencies sometimes make gross procedural errors (personally, I was just waiting for them to insist on filing a complaint and seeking compensation). Do not give in, and they will cancel the sale.

Regulation: Book VI "Market Practices and Consumer Protection" of the Economic Law Code and Directive 2011/83/EU of the European Parliament and Council of October 25, 2011, regarding consumer rights, extending the right of withdrawal to online auction sales.

And if they were to have the bad idea to initiate legal proceedings for such ridiculous amounts (remembering that they are not the owners of the sold item and at best have the right to personally claim the amount for which they feel aggrieved, namely their pathetic little 9%), there must be similar cases in France to this one in Belgium that could set a precedent: Judgment of the Court of Appeal of Liège of March 25, 2011, published May 2012, page 221 "The insertion on an online auction brokerage platform must be analyzed as an 'invitation to offer' or 'to submit a public offer' by which a seller has solicited the public to make the highest offer for the purchase of their good. It cannot be assimilated to a contract offer: Hervé JACQUEMIN, 'Electronic consent in European law', May 2009, page 134 and cited references; see also Thomas Schultz 'eBay: a legal system in formation?', 2005, volume 22, pages 27 to 51". One cannot deem a contract to be concluded unless the seller and buyer have made direct contact and agreed on the price, while in an online auction, this process is the result of an automated computerized sequence and the seller and buyer are never in direct contact to agree on the terms of the contract. In short, technically there is already no contract

I would be curious to see how the French Justice would respond to a decision from the Dutch court going in their favor given their abusive clauses and their disregard for European regulation...

Under pressure, you the sellers will refund the 2 buyers and wait for your sold products, but the buyers only send an empty box or just the accompanying papers without your products.
You have lost your sold products and additionally Catawiki will deduct from your other purchases to refund the buyers their auction fees for Catawiki and also the taxes on your sold product, so on 500 euro products sold, you lose 500 euros + 20 euros shipping sent + 20 euros shipping refund that the buyer sent the empty box + 19% buyer’s auction tax + 12.5% on sellers' taxes + 6.5% VAT tax Catawiki.

Hi, yes, I had the misfortune of buying a Dupont lighter. It's been two months since I paid €220 and still nothing, no package. The seller doesn't respond, Catawiki sends me messages saying that my package is on its way. Two months and still no package. They make me believe that it's the seller's fault or that there are too many cases to process. What can I do to get my refund? Thank you.

Me too (April 2021) I win the auctions on 2 lots of stamps during the same sale from the same seller, and contrary to Catawiki's promises, the seller charges me TWICE the selling fees. TEN emails sent to the sales site have gone unanswered, and as I have paid the full amount for both auctions plus the highest fees, Catawiki is now threatening me with cancellation of the sales and the confiscation (I assume from my payment) of the auction fees. Unavoidable SCAM!!!
