Hello, I changed my operator in May 2014. I switched from SFR to Free.
At Free, I was told that my SFR cancellation fees would be €30, but I received SFR cancellation fees of €100!
So I decided not to pay and to arrange something with Free, who of course doesn’t want to hear anything about it.
Now I am receiving letters from the bailiff Master Vennin based in 37. I am in 76.
A voicemail on my phone earlier told me to call back before 7 PM, otherwise the case would be sent to court and all costs would be mine, which would end up being much more than €100.
So I called, and by the way, I have never heard such unpleasant people! I had to call 5 times and hung up 4 times. If I don’t pay quickly, it will go to court and they threaten to freeze my bank account...
Do they have the right to do all this?
Configuration: iPhone / Safari 8.0

Hello everyone!
There are many scams from this cheap bailiff: >Read This< what surprises me is that all departments are affected!!?

Harassment is punishable by law, and I assume you received these letters in plain mail. The basic rule is simple, any REAL bailiff will tell you, no registered letter (LRAR), so you haven't received anything. Lastly, for a bailiff to seize assets, there needs to be a court judgment, to which you would have already been summoned.
Conclusion: do not let yourself be fooled by these pseudo debt collection companies that rely on intimidation and not very ethical methods to convince people to pay. If they're calling you on your mobile, block the number. It is also possible to block a number on your landline via your Freebox http://mafreebox.free.fr. Additionally, by logging into your Free account online, you can activate the "reject anonymous calls" option, which will send calls from hidden numbers to voicemail instead of ringing your landline.
The reason I know all this is because I’m with Free, I’ve activated all these free options, and therefore I'm not being harassed. Moreover, I once dealt with a debt collection company of this sort that sent me plain letters with all possible threats, one claiming seizure within 8 days, then another within 15 days; in short, nothing to intimidate me, and you should not be intimidated either. Sleep peacefully.

Hello,
Not quite accurate and even wrong.
A bailiff does not send a registered letter but delivers documents.
It is indeed a bailiff and not a collection agency.
Finally, it is true that without a judgment, there is no seizure, but what is still wrong is the summons to court; the injunction to pay procedure takes place without a summons.
The adviser is not the payer, so don't bury your head in the sand.

Quote from Georges Courteline:
Seeming like an idiot in the eyes of a fool is a gourmet’s delight. This is just a signature and not a personal attack.

Ladies and gentlemen,
I have also been a victim of harassment for over a year from the bailiff firm "Vennin Vibert" located in department 37.
I have been able to clearly record the phone conversations I have had with these people (when they didn't hang up on me...).
They are demanding a sum of €250 by SMS and email for a non-return of an SFR box from my previous contract dating back to 2013-2014... However, the equipment has indeed been returned, and everything has been sorted out with SFR. This doesn’t stop these so-called bailiffs from weekly harassing me...
I also have phone recordings from SFR's customer service certifying that I owe them nothing, and that these bailiffs have no right to demand such a sum since I am perfectly in order...
I urge anyone who has been a victim of this bailiff firm to keep all evidence that could incriminate them for dubious practices and harassment (emails, SMS, payment invoices, formal notices...).
I wish to file a complaint with the public prosecutor to denounce these practices, which I believe should not exist.
JUSTICE MUST BE SERVED!
This harassment has been twisting my stomach for some time now, and I think a collective complaint should be filed with the prosecutor in Tours to be heard!
I believe hundreds of people are victims of scams each year from this bailiff firm, and it is time to demand compensation for moral harm, and I mean every word of it.
Contact me as soon as possible by email (***@***) to gather as many facts and evidence as possible to shut down this firm, and for them to be judged as soon as possible, because this is indeed abuse of power and harassment! I have noted a large number of comments reporting the same damages and harms I have suffered; it is time to act!
To organize better, I also wish to create a Facebook page called "Vennin Vib Complaints." It will allow me to gather as many testimonies as possible so that the complaint has real weight in the eyes of the public prosecutor!
You will find the Facebook page address by typing @venninvib in the Facebook search bar...
We need documents and testimonies, so don’t hesitate!
I remain available to resolve this matter as quickly as possible...

Hello, I am in a similar situation to yours. This bailiff is threatening to seize my assets starting next week if I don't pay the total amount, or alternatively 150 euros per month. I had a payment plan of 30 euros established with the previous creditor (the company has been taken over and it's the new creditor who apparently hired this bailiff). I explained to them that I cannot pay this amount. And they are leaving me no choice! They haven't asked me for any proof of my income. I explained to them that I am unemployed due to my disability. I don't know what to do!
The Venin firm does exist, but it does not handle these cases.
And usually, you need to hire a bailiff from the jurisdiction of the court in your place of residence.... So!
Don't worry.
You must not respond at all.

Re:
Ahhhhhhhhhhhhhhhh.. The famous 'discount' if we pay right away.. Seen this many times.. This 'honest proposal' is generally offered when the debt cannot be subject to Forced Collection (Seizure..). In other words, there is 95% suspicion of prescription..
Of course, never give a credit card number!! That would be opening the door to thieves..
Let them screech and don’t panic.. Really no memory of anything that could have turned into a debt? Knowing the approximate date of such an event, we can look for any possible T.E..

Hello, I would like to be reimbursed for the amount of 448 euros regarding an overdraft at La Banque Postale. Here is my file reference: 459480604. I want the refund as soon as possible, preferably by check to my address: 13 Allée Georges Bizet. Otherwise, I will take legal action against you. Thank you for taking the necessary steps. My sincere regards.
At first, it was Recocash that was calling me. Now, from what I understand from them, it's about moving to a higher level.
Julian, thank you for taking the time to respond, so according to you, I have nothing to fear at all?
Thank you for your advice.
Nemrod: basically, what do you think I risk??
Hombourgeois: yes, it's this number...
And I think that yes, SFR put me on it because that's the amount they were demanding for the cancellation fees...

What Julian wrote is false, you risk a legal proceeding; as I mentioned, you are not at risk for now, but if the creditor decides to take legal action, they could then freeze your bank accounts or seize your car.
Remember, the adviser is never the one who pays. Follow their advice, and you will head straight for disaster and financial troubles.
Do as you wish; I'm not concerned, I'm just trying to help you.

The bailiff must be contacted in the department of the person who has a debt. This bailiff is a scammer who does not act legally. Personally, I sent him a registered letter reminding him of the law and indicating that I would take him to court and seek significant damages, and as if by chance, I haven't heard from him in over a year...
Hello.
Same problem, they mixed up the person and to make sure everything was sorted out, I called back. This time I spoke to a very aggressive lady who told me she didn't have time to waste and that she already knew it was a mistake. She was making incoherent statements.

Hello, since your last message, have they followed up with you or done anything?
I was subscribed to SFR and requested cancellation in October... by January they were still charging me so I rejected the payments and blocked them. They claim I owe a sum of 121 euros after multiple reminders, and now a letter from SCP Vennin has arrived at my home. What do I risk?
I was furious. I sent them a registered letter in September, after 4 CALLS!!!! Finally, the person canceled my subscription. I received a cancellation email dated X October. A month later, I continued to be charged... I had called them no less than 8 times!!!! They finally took the cancellation fees from me, but on their end, it had been canceled since October... They didn't understand why they were still charging me, but no one was doing anything and dealing with them is a nightmare!!!! I wanted to take legal action, but then I thought, forget it, I don't care. And now I receive this bailiff's letter, what a joke!!!

Hello
It is advised not to 'talk' to the ruffians from Debt Collection Agencies. As they say themselves: we don't care...
Prescription in this matter: See CPCE Art. L34-2
......................
The prescription is acquired, in favor of the user, for amounts owed for the payment of electronic communication services from an operator belonging to the categories mentioned in the previous paragraph when they have not been claimed within a one-year period starting from the date they became due.
To claim = through legal means... A letter, even if it takes the form of a >Letter of Formal Notice and sent by registered mail, does not interrupt the prescription period. All the more so for emails, texts, or phone chatter are worth NOTHING.
Date when the debt is due? Rough estimate of the supposed debt?
So please stop calling these good-for-nothings, silent radio. Let them scream in the desert.
And above all, give NOTHING, danger! Anyway, you are broke...
See you later!

Hello, my parents, aged 81 and 83, live in Charente (16) and they received a regular letter about a supposed debt of 8500 euros that came out of nowhere, along with threatening phone calls from a certain Venin Vibert in 37. I wrote a registered letter with acknowledgment of receipt requesting proof, and they replied last night, December 26, at 8:30 PM via email, saying they have nothing and that Neuilly Contentieux holds the proof. My parents are panicking, and they asked them for 250 euros per month. What should we do now? Thank you to anyone who can respond.
Even if I'm wrong on some points, we all know that we can't do anything against the incompetent people on the phones of the "hotlines" who lead you by the nose and hang up on you if they wish.
If I were you, I wouldn't let myself be walked over, wouldn't pay, and would take this matter to the local court, which is free, without a lawyer, and very quick.
Let's stop defending unscrupulous companies, no matter how well-known they are.

The other, as you wrote, was respectful of your username, which is not the case for you; you are borderline vulgar, and that's not how you're going to help.
This is a bailiff, not a debt collection agency, and even if he's not in his department, nothing prevents him from filing a payment order and then having it executed by a competent bailiff in the 76. Never bury your head in the sand when facing a bailiff.
What you did is not necessarily what Jo should do; the decision is up to him, he is the one concerned, he is the one who pays, so give wise advice, that's all we're asking of you.

I am in the same situation; I was actually forced to take an appointment on 02/08/17 by someone named Nadia who spoke to me in an unacceptable manner and did not honor the appointment, which is normal for this study. I invite you to bring their procedural flaw to the attention of the execution judge closest to you by presenting the evidence, as a sworn witness is not meant to abuse their powers over debtors, no matter their circumstances!
Me too, it's Nadia who has my file, a real piece of work that one, there's no other way to put it. Sorry for being vulgar, but she's disrespectful, hangs up on people, insults them, threatens them. I had just lost my grandfather when she called me. I was in tears and she laughed, saying there was no point in crying, she didn't give a damn. On top of that, I had paid the first time by credit card, and they tried by all means to keep charging my card. I had to block it.
I heard my girlfriend call this office and confirm how that woman spoke to her badly and forced her to pay without letting her speak! If anyone managed to get her name, because if she continues like this, we are thinking of suing her civilly. We were joking with my girlfriend yesterday, saying she has a fated name that is close to "Venom-Viper."
In any case, sending threats by email is nonsense!

Hello
In this case, it is urgent to wait!!
Especially do NOT negotiate anything, do NOT give anything until we know more..
Either the debt is nonexistent (homonymy..), or it is prescribed, or it is a real debt with a valid Enforcement Title (E.T)..
The handling of the problem is VERY different depending on the case..
Normally, the one who is claiming (amicably..) must provide a minimum of information in accordance with R124-4 of the Code of Civil Execution Procedures.
If the claim seems valid, it will be necessary to check:
1- The existence of a valid E.T..
2- The claimed amount, very often unduly inflated by interests prescribed for 5 years..
Between us, a 'claim' over the phone is not serious, legally it should be done by mail.. A bit 'suspicious'..
This is probably a 'pressure tactic' prior to a new request.. If the supposed Creditor offers a 'discount', it will be even more suspicious!
If you have no reference, you will not be able to demand from N.C the basis of the supposed debt.. Getting anything from those people is more than difficult..
Wait&See and NO panic!
Come back to the Forum in case of new developments..

You can also ask SFR if they have put you in litigation, and/or with a bailiff.

Hello, I just read your message. I'm also dealing with him. Please know that I've just learned that they are scammers; their site is not certified by the state for bailiffs. Let me explain my situation: a few years ago, I took out a consumer loan of 4,500 euros. Up till then, nothing extraordinary. Some time later, we had a significant financial issue, so I couldn't pay my monthly installments. I'm talking about this over 8 years ago. We thus made a debt relief file that was accepted and put on hold for two years. So, two years later, we were contacted again by the bailiffs about other loans I had. I've never refused to pay my debts, just to be clear, but strangely enough, I hadn't heard from Cetelem (I'm not going to chase them either; let's be realistic, I'm like everyone else). Strangely enough, we are still in 2017, and two months ago, my husband received a phone call saying that if we don't pay within 8 days, they will come to seize our furniture, car, etc. My husband remained calm and informed me. So, I took matters into my own hands, contacted them, and asked where this debt was coming from. I told them I was willing to pay, but I would like to have official documents. In short, they then offered to reduce my debt by half—over 2,000 euros—which seemed suspicious to me, don't you think? But on one condition: that I pay immediately. I told her that I didn't have that amount in my account and that it wouldn't be possible (who these days has that amount in their account, honestly?). So, I proposed paying 50 euros a month until the end of my debt. She refused, insisting on 130 euros or immediate seizure. Being a bit naive, I said okay; I had no choice, so I quickly paid.
But then I did some research on this bailiff and conducted my little investigation, and I learned that before seizing, I should have been informed of a court case and an enforceable title (just know that the public treasury doesn’t necessarily need that to act). A few days later, a very unpleasant woman called me and demanded that I pay the 130 euros again, which I complied with immediately (yes, still a bit naive). But I didn't hesitate to tell her that she didn't have to be so unpleasant and that it was borderline aggressive. In any case, she hung up on me, saying that she was paid to be unpleasant. I called back (yes, I'm still naive) and spoke with another person who was very nice. I introduced myself over the phone and told her that I had just spoken to her colleague, who was so unpleasant that I didn't even have time to give her my new address. She then told me that her colleague wanted to file a complaint against me because I had insulted her (uh, how do I say this? I exploded right away, yes, we'll talk about that later). I told her that's not true at all; I had never been unpleasant—she barked at me like a dog. They shouldn't take advantage of this. Anyway, I hung up while giving her my new address.
A few days later, my husband received another phone call, and that was the last straw. I sent them a message asking for the enforceable title, a copy of all our telephone conversations, and all the supposed letters sent to my home. That same evening, she called my husband, saying that I was completely in the wrong and that we had to pay, period. Anyway, we let it slide as I finally opened my eyes to the scam, except this Monday, I received a phone call saying that on Friday, my home, car, and everything would be seized. Uh, then I really panicked. I called my social worker, who also found this very suspicious and directed me to the legal access point. I explained the case to them, and they were very surprised. They gave me the phone number of a bailiff. I explained the case to them, and they said, "Oh my God, stop paying immediately; it's a huge scam." This reassured me but I remained doubtful nonetheless. The bailiffs told me to go directly to the gendarmerie, which I did immediately, and they confirmed that it was indeed a scam. I filed a complaint against this bailiff, and believe me, it’s not going to go down like this.
P.S. Sorry for the mistakes.

titmanu83, don't get carried away...! A real bailiff doesn't waste his time calling you or pursuing you over the phone; he simply sends you registered letters or postal mail. So, don’t get caught again.
At worst, I recommend that EVERYONE file a complaint against this bailiff's office at the contact details below:
http://www.huissiersdeparis.com/contactez-nous/
Contact: Tel: 01 42 96 19 46 Fax: 01 42 86 03 91
Email: chambredepartementale@huissierdeparis.com
And I also advise reporting these practices to the DGCCRF: https://www.economie.gouv.fr/dgccrf/contacter-dgccrf
General Directorate for Competition, Consumer Affairs and Fraud Control
Good luck

Hello, I also have a problem with this bailiff's office. Credit contracted in 2007. Financial issues meant I couldn't pay, no arrangements were possible at the time. I hadn't heard anything about this debt until a month ago. Last Friday afternoon, I received a call from them saying I either pay the full amount of 1300 euros or a monthly payment of 111 euros, otherwise they would seize my assets the following Tuesday morning. I had neither amount available. I eventually found my 111 euros. I sent them an email to confirm the payment made through their website. No response from them. I called them, and they said they hadn't received the email... The payment had been processed. Later, I sent them another email to propose 50 euros per month, which I had already suggested on the phone the previous Friday and had been refused... I also wanted to know about the registered letters they must have sent me. They replied that they do not send registered letters, only regular mail, which I never received. And that for any requests, they do not process them by email but only by phone. I wonder if all of this is legal and if they are within their rights because 10 years later seems excessive to me. Can you help me? Let me know where I can turn to, please? Thank you in advance.
Hello
In short:
An office run by a bailiff can still claim a refund for an alleged debt. Two scenarios:
1- A judgment has been rendered. Given the dates, an enforceable title would still be valid today. The debtor can only avoid legal action by settling the debt..
Here a REAL bailiff does not call but presents official documents bearing the Marianne stamp.
2- No judgment and the debt is barred/prescribed.. The collector then puts on a show to intimidate.. The frightened pigeon negotiates, gives a little money..
Too late! What he has given or negotiated can become an Acknowledgment of Debt restarting the infernal machine by breaking the acquired prescription.
Stop all negotiations, do not commit to ANYTHING, do not give ANYTHING..
Get assistance from a Consumer Association that will check the situation and advise you. Hoping it's not too late..
Talk soon!

Hello,
I would like to ask you for advice. I am also dealing with this bailiff.
The first time I gave in to his blackmail and I pay him an amount every month. However, I can't get a statement or a document indicating what I pay him every month. So I end up wondering if this is legal.
Now it's happening again, he sends me a threatening letter to settle another debt within 4 days and I love the 'despite our numerous reminders', it's funny because this is the first letter for this new matter. I received this letter on Friday. Today I received a message on my phone that he will come to seize my goods, the car and everything else on........ at ......
Except that I have no official document from the court. Moreover, the court selects a bailiff from my department and there we make a repayment plan. I have done my research.
I should specify that this bailiff is not from my department.
What can I do? How can I counter him because from what I've read, I think this is a nice scam since there is no official document and also when I repay I have no document stating this.
I think this bailiff works for Neuilly Contentieux and he does not follow regulation.

Hello, I am experiencing the same thing as you from this bailiff, I have been paying every month for a year and there is no way to obtain a document summarizing all the payments already made. When I dared to ask the "charming lady" on the other end of the line, she told me to keep track of my own payments, is that normal????
I haven't gone to court, and it's impossible to discuss with them, they immediately get angry and threaten.
What can I do to find out where my money has gone, does it actually pay off the debt I’m supposed to be paying, do I have to keep paying them?????
If someone could respond to me because I have already paid a substantial amount and when they threatened to take me to court because I could not pay the balance in full, I said go ahead, I thought that this way my case would go to another bailiff in my area whom I could talk to instead of being yelled at.
Moreover, they dare to tell me, you are not making any effort, we talk about it with their client, it will go badly for you even though I pay every month without fail....
Thank you in advance if you could help me and also help the lady in the post to which I am responding.
Have a good day.

For my part, I refused to respond to them and kept the threats on my phone. Threats that I played for a lawyer who was stunned and confirmed to me that I could file a complaint against this bailiff.
Since I stopped responding, I have not heard from them. The last time I spoke to them on the phone, I also threatened to file a complaint and send an email to the chamber of bailiffs, along with their various threatening letters.

Hello, I was with SFR until the end of my contract in September 2017. Before my cancellation, I broke my mobile, and in May 2017, I went to the SFR agency to ask if there was any possibility of getting a new phone. Their response was no, and the only thing they offered me was to lower my plan from €29.90 to €19.90 while waiting for July 2017, when I could then change my plan with the Chatel law. So I owed them €54. To my surprise, I received a cancellation bill of €189. I contest these charges; their response is that at the time of the plan change, I was re-contracted for 12 months, so my contract end date is November instead of September 2017. I refuse to pay this amount and sent a registered letter with my contestation letter and a request for a new bill, meaning €54. They sent me an email with the same letter, stating they want nothing to know and that I owe this cancellation fee... I refuse to pay. Following this, they sent me a letter from a bailiff threatening legal action, with calls and messages, two letters, and today an appointment at their office in 37 while I live in 83; otherwise, I have to call them. I refuse to pay this amount, which I see as a scam, and I might go to court. What do you think of all this? Thank you for your response.
Hello, I have the same issue right now. Today they are asking me for €380 because they say I didn't return the SFR box, but I sent everything back myself. What can I do because this woman keeps harassing me, and when I call to pay, she hangs up on me because she doesn't want to come to an arrangement.
Hello
I just received an email from this bailiff asking for the amount of €221.10 for unpaid insurance from Generali, but I'm not with that insurance. I have been with the same insurance, Thélem, for years. I inquired with a legal service, and they said not to call or respond to their emails, otherwise you will always be harassed.

What are the authorities doing?
Don't panic. It is indeed a scam.
The requests made by the people hiding behind this scheme have no substance. They simply ask for money with the brain of a fossilized mussel!!!! The method is crude, imprecise, full of errors regarding the amounts requested. It’s the work of small hands who want to make easy and quick money based on people's gullibility.
Wrong, we are in 2021 – we are educated – trained – over-informed – we have a 360° view, something you do not possess. When you randomly target people based on information you exploit, you don’t know who you’re hitting??
These individuals target vulnerable and uninformed people. If they make 1000 requests a day and 50 respond positively, the amounts can be significant.
Please – Don’t let yourself be trapped. No response is an answer;
The warnings from internet users are absolutely true. The number 02 47 91 38 72 is an organized scam. The malicious individuals responding do not fit the profile of an official debt collection agency registered in the commercial registry at all.
Under French law, a legitimate debt collection – that is to say, one considered real and serious – is a formal request by registered letter with acknowledgment of receipt – your response must also be by registered letter with acknowledgment of receipt. You have a right to respond. This is very important – French law requires it.
You are legally protected – French law is clear – individuals requesting the collection of an amount must provide "proof" in writing of the request. I repeat, there must be a written document and a detailed and verifiable request. Otherwise, the procedure is void and thus inadmissible. One does not respond to falsified letters and to overly excited individuals if you call directly.
Beware..... of the scam regarding your mobile phone, they are plundering your confidential data. And I wonder if that’s not the ultimate goal..
This number 02 47 91 38 72 skips directly to the money. Once and for all, this is not how French law works. Harassment is punished very severely.
I am angry that this type of clumsy and shameful action has been happening with impunity since 2016 now.
These people must be blacklisted by our jurisdiction.
Often denounced, SFR is to be avoided really to be avoided – it is not a serious operator – how can it still have subscribers??? FLEE – when you leave and once your file is paid and duly closed, expect unjustified money requests as denounced by internet users’ comments.
The fundamental question posed is: how do these Alien individuals operate, with what support?
How do they retrieve phone data and addresses of victims – Who informs them??? Who provides the contact files?? That’s the core problem. Knowing that SFR is often the vessel for these false debt collection requests, one can imagine that malevolent staff regularly provide information data.
If there is an ounce of dignity left at SFR, it must end this practice and return to the principles of strict commercial law. Clean up its services and conduct an analysis of what is happening from top to bottom, including the basement and sub-basement – From the customer’s perspective, it is clear that the functioning of its services is chaotic.
Trace back to the source of the information exploited by these individuals!!! Complicit Who? Why? How?
We see that this affects the entire country – that the intimidation procedures and behavior are identical everywhere. The terms used are similar – therefore they apply a unique method – this suggests that they have no resources, neither material nor human – one can imagine 1, 2, or at most 3 people.
Moreover, they repeatedly make mistakes in the amount requested, often changing the amount. This proves they are neither organized nor rigorous. Last point, they move to the payment phase without explaining the nature of the so-called debt, they are in a hurry and on this point alone you should be alerted.
This is the core issue – what is the source of their information??? That’s the basic reflection.
Best regards to all.
Hello
I have been in a panic for 18 months; I have been paying 50 euros every month to this bailiff. He contacted me by phone through my neighbor. I called the next day; at that time I was very unwell. I panicked and didn't ask too many questions, too happy that they accepted 50 euros.
Considering the testimonies, yesterday I called without my reference and received insults. I explained that everywhere, by giving their name, you can find the file. Again, I was insulted and was told there was a reason, and I replied that there must indeed be one. I think they are cashing in for themselves because no reference was given in the SMS.
I am going to stop paying, but the threats of seizure will come pouring in.
I would like to know if they can actually seize or block my account because I am sure this file is closed, settled, or very old. Having been ill, I forgot a bit. There you go.
