Hello,

1and1 is sending an invoice to all its customers for an option never ordered, "Extended PHP4 Support," for an amount of €4.57 including tax.
We received an email on May 22 and took the necessary steps.

My name is Sylvain Lebedel. I would like to inform you of upcoming changes regarding your 1&1 hosting package 31704030.

You are using version 4 of the PHP programming language. Unfortunately, this version is no longer current, and its development as an Open Source product has not been maintained since 2008 by the PHP community.

That is why we advise you to quickly upgrade to version 5.4. This version will allow your applications and scripts to operate reliably and securely.

You can change the PHP version at any time in your 1&1 Customer Area.

Follow the link "Global PHP Version" and select version 5.4. Then check your scripts to ensure that they are compatible with version 5.4.


After discussing with the billing department at 1and1, it is indeed a scam

1&1 has around 100,000 customers multiplied by €3.81 excluding tax = €381,000 excluding tax

I think it is necessary to denounce this deception from this hosting provider who is not new to this.

This is indeed an abusive billing because according to article L122-3 of the Consumer Code, the provision of goods or services without prior order is prohibited and no obligation can be placed on the customer if 1&1 provides a service despite this prohibition.

I had the same misadventure with a bill for: 1&1 Extended Support PHP5.2 at €1.27 excluding VAT per month, a service that I never requested.

1&1 is clearly practicing pressure selling and risks a fine of €150,000 and 2 years in prison.

The service "1&1 Extended PHP5.2 Support" refers to the fact that you are still using the PHP5.2 version previously provided in your contract with 1&1. At the time your contract was established with 1&1, it was the latest version we could offer you. Subsequently, as PHP underwent significant developments, we could not upgrade the PHP5.2 version included in your contract without causing a malfunction on your currently live site. Therefore, we were waiting for an action from you beforehand.

That is why we provided you with a free service allowing you to choose a more recent (and thus safer) version of PHP directly from your client area. It is indeed a

I am currently transferring all the websites hosted with 1and1 to OVH. Much more professional. Flee from 1and1, which charges you for nothing. With OVH, you can choose the version of PHP you want to use and nothing is charged to you. You can really feel the scam at 1and1, where their only aim is to SELL...

Uh ... At 1&1 you can also choose the version of PHP you want to use.
Indeed, you pay a supplement for the older versions, but I have a hard time understanding the desire to use PHP4 when we are at version 5++.
It's a bit like wanting to start a fire by rubbing pieces of wood together; personally, I prefer to use a lighter.

I don't see where the scam is because if I understand correctly, 1&1 is informing you that it will stop using PHP 4 and that you need to update your scripts to PHP 5.

If, on the date of the change, you haven't updated your scripts, 1&1 bills you 4.57 euros so that your site remains visible with PHP 4.

Would you have preferred them to just shut down your site?

I just wanted to add one last clarification to this comment.

Please be aware that this option for "Extended PHP4 Support" can be canceled at any time, in order to no longer be charged for it.

However, once this cancellation is effective, your hosting will no longer support PHP4. All your PHP scripts will be interpreted in PHP5. You may encounter errors in the interpretation of your pages by our servers (if your scripts are not compatible with PHP5). You can find all the prerequisites on the official PHP.net page: http://php.net//manual/en/migration5.php

We therefore recommend that you first switch to a more recent PHP version (procedure communicated in the email you received), and if after this switch to PHP5 is successful (absence of error messages), then to cancel the option (which has become unnecessary) from your client area, using the cancellation tool.

Note: Once this option is canceled, it cannot be subscribed to again to ensure compatibility with your old scripts.

In France, Mr. Swen, it is not legal to charge your client's credit card without their express consent for an option that was not clearly ordered by said client. The burden of proof is on you. Failing to produce the signed order form could be classified as fraud. This is a criminal offense.
Good luck to your company, which is clearly bending the law and presumably counting on the fact that your current clients (future ex-clients?) will not file a complaint given the minor harm suffered of 4.57...
That said, if each client writes a simple letter to the former fraud prevention agency: consumer protection, an investigation and procedure will be initiated by state services to put a stop to these practices, that's obvious.

In digital purchases (i.e., online service subscriptions and e-commerce), it doesn't exist.
Another example: when you receive a ticket (from a speed camera), there is generally neither photo nor signed acknowledgment of the offense on your part, just your license plate. But if that license plate number was drawn from a hat, you would still have to pay! Yet, many associations have come together, attempted legal actions, and did the whole charade. But the justice system doesn't care, simply because the world is made that way now.
To get back to the topic, many people subscribe without knowing what they're checking, because we don't know, or more often, we don't read! So, to be a spokesperson for the anti-fraud fight in a context and past actions of which we know nothing, is a bit much :)

1&1 has indeed sent an email to its customers to warn them to upgrade their domain names to a version higher than PHP 5.4 or face billing. However, even after making this change, 1&1 still charges for the PHP 5.4 service. To avoid being billed, it is necessary to go to the cancellation tool and cancel the extended PHP 5.4 service. Simply upgrading their domain names to PHP 5.6 is not enough. And 1&1 does not mention this in its email. For this reason, it is indeed a scam. 1&1, aware of the illegal nature of its approach, refunds customers upon simple request if they take the time to check their bill.

I react to Sven's pitiful attempt to justify the practices of 1&1 and I maintain that these practices resemble fraud. I am indeed willing to discuss this before a judge.

To summarize my experience, I recall the facts:
- On 11/15/2014, I received a bill of 4.57 euros for "Extended PHP5.2 Support" from 11/6/2014 to 02/06/2015.
- On 11/17/2014, I replied that since I had not subscribed to any new option for my hosting, I assumed it was an error from 1&1 and that I would not pay this bill.
- On 11/21/2014, 1&1 sent me a generic email indicating how to cancel the PHP option. The cancellation process, rather complicated, consists of 8 steps. Moreover, by doing so, I would implicitly admit the validity of the bill. I do not understand why I would have to cancel (wasting time) an option that I did not subscribe to. I therefore maintain my initial position.
- On 12/10/2014, I received a reminder from 1&1 with threats of late fees and account suspension.
- I responded on 12/12/2014, stating in particular that: "pursuant to article L122-3 of the Consumer Code, the provision of goods or services without prior order is prohibited and no obligation can be placed on me if 1&1 has provided a service despite this prohibition."
- At the end of December, without prior warning, my account was suspended. No more website, no more email, no more FTP, nothing at all.
- On 01/30/2015, I urged 1&1 to unblock my account and immediately restore all subscribed and prepaid services.
- On 02/11/2015, 1&1 informed me: "... we note that to date, no request for cancellation [of the PHP option] has been made. Invoice 202502894802 in the amount of 4.57€ remains due." (sic)
- On 02/14/2015, my domain name was to be renewed. I would have liked to keep it, but in the email of 02/11/2015, 1&1 indicated regarding the renewal of the domain name: "... it is important that your payment information is up to date. We have compiled the information for you so that you can update your payment information yourself." My payment information was indeed up to date as I was paying by check. 1&1 was actually demanding my credit card number to unblock my account and renew my domain. No other alternative was offered to me. No effort from 1&1 to resolve this (albeit minor) dispute.

I therefore lost with 1&1:
- 2 months of prepaid hosting
- all emails since the end of December
- all data hosted on the server
- my website
- my domain name
- everything that goes with it: reputation, clients, friends ...

All this because 1&1, not respecting the Consumer Code, improperly billed me for an unsolicited service. The damage is enormous for me. I am also a client of Gandi, LWS, and now OVH, with whom everything is going well, thank you. With 1&1, I have had two serious problems in 2 years and I can only advise to steer clear of this provider like the plague.

I received the email from 1and1 and I switched my sites and those of some of my affected clients to PHP5

1and1 still charged us for PHP4...
while the servers are on PHP5 - screenshot sent to their customer service -

The reason?
You have to go to the cancellation tool to cancel this "option"
In fact, it's not an option... it's just a module necessary for the proper functioning of websites and has never been part of an option
a bit like Peugeot announcing that they charge for the fourth wheel of their vehicles...

In short, they are charging for something that was previously free, that is outdated, that must be useful for 0.01% of the sites they host... that is becoming obsolete, that I do not use... and that becomes chargeable for 100% if they do not cancel

it's serious if you call yourself a webmaster and you're still developing in PHP4...
It's been over 10 years that PHP5 has been used and PHP4 is not as efficient and secure, hence the existence of a new version.

As for billing without consent, it is indeed abusive; if they notify you, you can:
_dispute the payment and get a refund if you are on PHP5
_pay to have a PHP4 server as indicated... and think about rebuilding your site with current technology.

except that you forgot to notify 1&1 that you were no longer using php4 as requested in the message, did you? As a result, 1&1 is logically charging you for the provision of php4 in addition to php5 on the server.
The fact that you are not using it does not change anything since it is the possibility of using it and not its actual use that is being charged to you.

To you personally and to others, just to let you know that this is not a scam, 1&1 having respected the terms of the modifications of the initial contract, after I understand your anger because the message is convoluted.
That said, a little pressure on 1&1 with a threat to switch everything to OVH will surely allow you to recover the funds.

Same problem, they wanted to charge me for the "upgrade" to PHP4 that I have never used for €4.57.

After two refusals, they blocked and closed my site. And in my client area, I only have access to the payment method to unblock my site.

I am going to cancel my subscription right away and I will make sure not to recommend this hosting provider anymore.

I just canceled the PH4 option, but I never received the email asking me to switch from PH4 to PH5, so I will request a refund for these invoices of €4.57 (a matter of principle)
Indeed, it was when I saw these invoices and tried to understand because to me it's all "Chinese"
1&1 was supposed to send me this email before charging my account.
Otherwise, nothing to report with 1&1.

Same for me, site offline, I called customer service, I asked to cancel the PHP4 service, the representative I spoke with canceled this option and waived the invoice of €4.57 (without me needing to get angry). It lasted 3 minutes! ... I don't count the waiting time of 17 minutes, but it's a regular-rate call.
I advise everyone in my situation to call customer service and simply cancel this "PHP4 service", the invoice is also canceled.

I confirm, I have the same problem.
I see a payment of 4.57 euros for 1&1 on my bank account, I have never subscribed to any option.
There is an invoice in my client area.
All of this is forced selling and absolutely abnormal.
When searching on Google, it's crazy the number of websites, forums, blogs, etc., that talk about billing issues with 1&1.

I'm not even using my web spaces... It said "unknown PHP version" on the created (and empty...) web spaces.

Same as everyone here. I had domain names without a website (parked for now) and while looking at my bank statement, I was surprised to see these charges. I have never needed this support and I never requested it. I also never received an email (probably in spam)

To me, this is a scam and it's not the first one from 1and1.

Are you sure that the email in question was really from 1&1 or that they weren't victims of an attack that sent these emails to clients? That seems a thousand times more logical and probable.

I just received an invoice too, on 11/19/214 that takes effect on 11/06/2014!!!

In plain terms, they're taking the initiative to charge me for an option without my consent, without informing me!
They're sending me an invoice long after the approval of this option!

I logged into the site and canceled the option. It will be effective on 11/30/2014!

In short, I am going to pay for an option that I did not request from 11/06/2014 to 11/30/2014!

To me, this is what I call forced selling! A scam!

What will happen now, 1and1?

I will back up my databases, my files, and I’m leaving you!

I prefer to pay more elsewhere than to endure your way of treating your customers!

For your information, I have 11 domain names and 2 hosting (2 contracts)!

Your business strategy really needs to be reviewed!

In short, they are taking the initiative to put me on an option without my agreement, without notifying me!

I just got off the phone with 1&1 and there was no issue: I hadn't received the email in 2014 so they're issuing me a credit for the 3 invoices of €4.57
And all of this in 3 minutes without any discussion and very kindly, so for me: I consider that there is no scam.

For my part, the customer service is the best of all the hosting providers, since it's the only one I know, but in all my life I've had problems at 2 a.m., they respond, and I’ve never had issues with them, especially since I received the PHP email. It's just that they charge in case you stay on an obsolete PHP version, so you need to update your PHP version. It's normal because if your PHP version is outdated, then no more updates, etc. 1and1 provides a service to keep it active and for the security of our sites, so it’s perfectly normal that they charge for it now. In 3 clicks, it's sorted (the version to change is accessible from the email), so there's no need to make a big deal about it, especially since they are very helpful and never leave you without an answer like some do. And as I saw a little higher, they refund if it’s their fault and don’t quibble about migrating a domain to another host like my friend at XXXX who took 6 months to get the domain transferred!! Long live 1and1, hehe.

How about you stop ruining the forum with your spam links? In summary:

- You're not going to gain anything with search engines because the links are nofollow
- Don't imagine you're going to get 1000 more visits per day using this method
- You're just going to create a negative image of your site with this type of method to promote it
- Instead, take the time to publish interesting content, which is the key to a successful (or not) site.

I confirm the scam; they send an email that, according to their T&Cs, is for the acceptance of a paid option. Without any proof of receiving and reading this email, they charge your credit card. I called the sales department to get these explanations. I am canceling my account with them and migrating to OVH.

To accept, you have nothing to do. 1&1 takes care of everything: your old contract at €1.99 excluding VAT per month will be automatically converted to a "1&1 Unlimited" contract...
Which means it will be at €4.99 excluding VAT... Basically, if we don't see the email go through, it will cost €4.99 excluding VAT instead of €1.99 excluding VAT...
So I took the "starter" contract at €2.99 excluding VAT/ but it still gives: €43/year instead of €28/year
It's true that it's more "performant," I use 2GB for my two sites and now there are 50GB available, which doesn't really help me.
I can sense a domain change coming...

I received the same email from 1and1 on April 2, 2015. This email does indeed appear to come from 1and1. If that's the case, it's unacceptable. I have already transferred my Wordpress site to OVH on an account that I just created for €1.99 excluding VAT per month. I'm still looking to confirm whether the email from 1and1 is authentic. Does anyone have confirmation?
Note that the email indicates my customer ID and my contract number, which seems to authenticate the origin of the message.

As long as the email you receive includes your customer number and your contract number with 1&1, the message is authentic.

In your particular situation, the email you received is indeed a communication from 1&1 regarding the old contracts, for which maintenance can no longer be guaranteed on our shared hosting servers.
