Hello,

I have a dispute with an online sales company mentioned in the title of my message. Indeed, 4 vinyl records were missing from the delivery. I sent emails but apparently, they are not checking their inbox which is overloaded. I then sent a letter requesting a refund for the 4 vinyl records and received no response. What options do I have? You make your purchases remotely, either online or from a mail-order catalog. The new provisions of the Chatel law "for the development of competition in the service of consumers," applicable since June 1st, enhance the rights you have as a remote buyer.

Since June 1, 2008, consumers who purchase on a website or catalog are better protected. More information before the purchase, the guarantee of being reimbursed in case of return of items... Enough to better stand up for yourself!
The merchant can no longer just provide you with a simple indicative delivery date. They must specify a maximum delivery date for the product or execution of the service ordered. This date must be included in the commercial document or on the website, regardless of the purchase price of the good or service.
Otherwise, the merchant will be considered to have to deliver the good or perform the service as soon as the contract is concluded.
In case of delivery delay, when the maximum delivery date is exceeded by the merchant, you can choose to cancel your order. You have a period of 60 days from the originally scheduled delivery date to send your cancellation request, via registered letter with acknowledgment of receipt. The sale is canceled upon receipt of your letter by the merchant, unless delivery occurred between the sending and receipt of your letter.
When the sale is canceled, the merchant must refund you the total amount paid, including delivery fees, no later than 30 days.
The online seller, or the distance seller via catalog, must provide complete information. They are particularly required to mention "the existence of a right of withdrawal and its possible limits or, in cases where this right does not apply, the absence of a right of withdrawal." This mention is now part of the mandatory information (See "All information is included in the contract").
The withdrawal period is a period during which you can withdraw from your purchase without having to justify yourself and without financial repercussions. For remote sales of goods and services, you have a withdrawal period of 7 days from the date of receipt of the ordered good or acceptance of the service offer. When this period expires on a Saturday, Sunday, or public holiday, it is extended to the first working day following. However, there is no withdrawal period for the following remote purchases: - travel, - service provisions for accommodation, transport, leisure for a specific date (train, plane tickets, hotel night, concert ticket) or whose execution occurs before the expiration of the period, - perishable goods or items sold sealed (CDs, software…) if they are unsealed - subscriptions to newspapers.
The seller is required to provide you with various information regarding the good sold or the service provided, upon ordering or booking. Among these:
- the characteristics of the good or service offered remotely,
- the information identifying the seller (name, phone number, address of the establishment or headquarters),
- the price including all taxes (TTC),
- the payment, delivery, or execution modalities,
- the delivery costs,
- the validity period of the offer,
- the address for complaint services,
- the minimum duration of the contract if necessary,
- the warranty and after-sales service conditions.

Another mandatory piece of information upon concluding the contract: the seller must provide you with a call number allowing you to track your order, without any surcharge.
If all these law-required information have not been provided to you by the seller or service provider, the withdrawal period is extended to 3 months. If within this period the seller provides you with this information, you then have a 7-day period from the receipt of this information.

If you exercise your right of withdrawal, with the return of delivered items, the seller has been required since June 1, 2008, to refund you "the total amount paid," meaning the price of the item and the delivery fees paid at the order. But the return shipping costs of the returned goods are your responsibility.
The merchant must refund you within a maximum period of 30 days. Another new feature of the Chatel law is that the seller must refund you by any payment method. In plain terms, this means that the seller can no longer impose a refund solely in the form of a credit note. Credit notes are not prohibited and can still be a mode of refund, but only if you have expressed your agreement on this mode of refund.
The distance seller, online merchant, or catalog seller must set up a non-premium telephone service, also known as a "hotline." This number must allow you to track your order, exercise your right of withdrawal, or activate a warranty without incurring additional costs, other than the cost of communication.
And the phone number provided by the seller or service provider must allow "effective contact" with the seller. It must not only lead to a voicemail or other system without ever allowing you to reach an operator or a competent service.

I also have a dispute with pink cat records, since 10/28/08 an order of 6 records was sent but never arrived...the tracking number is nonexistent on the postal service's website, their email inbox is full, there’s no phone number or hotline, however, the records have been charged. I sent a registered letter and it has indeed been returned, but no action from them...what to do???

I myself am in a dispute with Pink Cat Records since 10/24/08. An order for about 180 euros.
I received an email confirming the shipment! The post office has no trace of the package and the amount has been cashed.

I sent a registered letter, they replied saying there had been a problem with a staff member, and now they're just stringing me along, repeating that I'll receive it in a week...

What should I do to get my money back?

Hello,

I am in the same situation as you, I ordered 10 vinyl records from the famous site www.pinkcat-records.com for a total of 103.5 euros in November 2008 (on 17/11/2008 at 2:53 PM!!). Since then, there has been no shipment, and the emails have gone unanswered... I think this is turning out to be a big scam.

I haven't sent a formal notice because I think it's a waste of money.

I think we should come together to gather our complaints and address them to a consumer association, so that we can make them back down.

If we could stay in touch through this topic, to move things forward and bring in other complainants.

Hello,

Still on the same idea, one of us should gather the complaints from each of us (including exchanged emails, unpaid orders that were quickly charged...) and compile everything into a single file to present to a consumer association that can seek to get into the head of the manager of www.pinkcat-records.com.

Afterwards, I think that with our credit card payment we benefit from free legal assistance, and that could really hurt www.pinkcat-records.com.

As I mentioned, I am at your disposal, hoping we don't end up with a hundred complaints after all!

We must not give up; I know it’s annoying, but it’s part of life and it gives us experience for disputes involving even larger sums.

I tried to contact UFC Que Choisir by phone at 5:01 PM, but they only had availability until 5:00 PM...

I went to the UFC Que Choisir website for my city, and for disputes, they ask for a membership fee of 33 euros for the year... for a stolen amount of 103.50 euros, it's not great.

I looked online, and it seems possible to bring the case to the local judge for this type of issue, and apparently, it's free. So I'm putting together my file, and as soon as I have a moment, I'll send it all in.

I will take my time, but I will do it.

I don't know what you think, but it seems to me to be the simplest approach, but it is an individual process.

Only the justice system can find him, as an identity document must be provided for registration (so his civil status can be retrieved). But the Justice can find him in their files (identity document, vehicle registration, driver's license...)

Totally agree with you, but I'm in the 13 and this is my first dispute so I don't have any contacts. I paid by card and I'm open to any claims... just need to find the right procedure...

Only the justice system can find him again, as an ID must be provided for registration (thus his civil status can be found). But the Justice can locate him in their records (ID, vehicle registration, driver's license...)

For my part, I put together a little file and sent it to my local judge, we'll see how it goes, I'm not in a position to spend 100 euros just to eat, but if everyone turns a blind eye, he will keep scamming everyone.

I also lost 100 euros at PINK CAT RECORDS, no way to reach them by phone or fax, it’s really a nightmare. My last order on this site was on 01/09/2008 and my order had been processed correctly but after that I thought there was a problem because there were no more returns in stock or new products.
You can't trust anyone anymore!

Hello, I’ve been trying to reach them for 2 weeks to get some news and now I come across this forum! It really worries me, it confirms my fear of a scam. Well, for me it’s only 40 euros compared to all of you, but this is my 5th order with them and everything was fine until today! For your information, my order is marked as PENDING, I don’t even have a tracking number! But they charged me straight away!...
I’m bookmarking this blog and I hope your suggestion of banding together to reach them is still valid... and I’m sure we’re not the only ones!

Otherwise, I live in La Rochelle, 1 hour from their listed address! During the week, I’ll try to go there and see if it really is closed! I’ll keep you updated on this same forum as soon as I know more!

Salut, j'ai aussi eu un souci avec Pinkcat. Au départ, ils ne répondaient pas aux mails que je leur envoyais. Jusqu'à aujourd'hui, j'ai reçu une réponse ce matin comprenant des excuses et une régularisation de mon problème, donc essaye de les recontacter, c'est tout ce que j'ai à proposer.

I also dealt with their incompetence on an order of 150 euros
no response to the email 1 month and a half later I sent a registered letter of formal notice for delivery 2 days after my order shipped.. I didn't receive it but I hope they didn't forget anything I'm expecting anything

Here is my procedure at the Court of Tours involving the proximity judge that has paid off. They quickly sent all the vinyls. I found it almost a pity that I couldn't go all the way to see how it felt...

On the other hand, no explanation from the seller... this will be my last order!

So, to get compensation you have to take action, that's all.

I had the same unfortunate experience with this shop at the beginning of September: an order shipped with a non-existent tracking number, weeks of delays... Eventually, after a lot of emails and phone messages that went unanswered, I ended up receiving a message informing me that an issue in the organization of the structure had considerably slowed down the delivery of packages. Well. Strangely, I still received my package - complete! - two days later. The fact that I live less than an hour's drive from this young man's house might have played a role...
In any case, naively, I thought that things had returned to normal since then and I was even planning to order from them again... But given the number of ongoing complaints, I will refrain. Good luck to everyone.

It had been "Pending" for 3 months & yesterday it changed to "In preparation"… Strange, right?

Really outrageous.. if we have to send someone to court to receive our vinyls….

so here it is, I also got scammed by the so-called Pink Cat Records company. I placed an order for €85, I think it was about 6 vinyl records, all under €100. But I got tricked; I never received that order, but they definitely cashed the check!! **So I decided to file a complaint at the local gendarmerie where I live.** And of course, by some miracle, the police did their job as they should, and this dishonest person reimbursed me the full amount of my order. .. **So there it is, I could sleep peacefully. But part of my motivation has been somewhat destroyed for music.
**But justice has been done.** A piece of advice to young and older people alike: be careful with websites on the internet, you can’t always spot scams, consult forums or friends before buying online, so there you go and take care.. **

The company Pinkcat Records has been in judicial liquidation since March 18, 2009. I called the company responsible for its liquidation, for all unfulfilled orders, you just need to send them a letter with the internet invoices, etc., and an explanatory letter (the debt collection company is based in La Roche-sur-Yon). Hello, I wanted to know how your actions against Pink Cat Record, which is undergoing judicial liquidation, are progressing?
I also got taken in, ordered on February 24 and just a few days later they went into liquidation.

I am sending a letter to the judicial administrator to recover my vinyl records or my money.

Is there any progress on your side?

I sent a registered letter to the judicial liquidator and I am going to file a complaint against Pink Cat Records because they did not comply with the Chatel law regarding the hotline number and the delivery time, and since they are in liquidation, they should no longer be allowed to sell by mail order.

I opened my email this morning and found a message from Pink Cat informing me of a judicial liquidation. At first, I didn’t get it, but after reading all your messages, I understand now......

I had placed a few orders on this site some time ago. One day, I received a vinyl that I hadn’t ordered instead of another one (the remixes instead of the original). I called the manager, and he told me he would take care of it, but then no news, and I ended up letting it go after finding the record I was looking for elsewhere...... I thought that everyone makes mistakes.

Well, I never imagined that so many people were "victims" of a guy who doesn’t know how to run his shop.

It's a shame because the music selection was actually pretty good.
