Hello everyone! This is my first question on this site... and it annoys me to have to come to this, but I have no other choice given my situation. To explain briefly, I was in contact with a girl on Instagram, and we hit it off well. We sent each other intimate photos after a few weeks, but the problem is that one evening, I sent her a photo showing everything. And she took a screenshot. Before deactivating her Instagram account (I know this because my friends couldn’t find her anymore by typing her username in the search bar). I wanted to know if it’s possible to file a complaint against someone on Instagram who has deactivated their account? Can we trace her IP address to find her even if her account is inactive and not yet deleted (I hope)? Normally, there is a 30-day procedure before the permanent deletion of an Instagram account, if I believe what I have read on multiple sites... So that's my problem, I don't know if the police will just laugh in my face if I go to file a complaint, and above all, I don't know if we can trace the IP address of a deactivated account. If you have any answers for me, I would be very grateful. I don’t want to seem ridiculous in the eyes of the police/officers. Thank you for your responses. Anthony

There is no way, except through judicial police, to requisition a site or a provider to obtain private data, and in any case, there is no criminal qualification as long as such a photo that you sent willingly is not distributed.

Thank you for your response, but what do you mean? Do I have to wait for my photo to be circulated if I want the police to take action? Is that correct?

Quite right, in the meantime, there is no offense, therefore no complaint.

Moreover, it wouldn't survive long if it were put online, but even if that were the case, we would hardly have any means of action: except in particular cases (for example, pedophilia), the judiciary has other fish to fry and virtually no means to intervene on websites hosted abroad. It is therefore highly unlikely that the complaint would be recorded and that, even if it is, the prosecutor would take action on it.

I take examples to inform myself: if a person pays for a video, for instance, at an exorbitant price (let's say €20,000), the police can trace the IP if the person files a complaint for not having received their money, right? Given that it is a significant amount.

End of the discussion for me.

Your money story is not criminal either; it's civil, for which we summon to the civil court without filing a complaint.

The judicial police indeed have the ability to seek to obtain a certain amount of information as part of an investigation (which does not mean they will succeed), I don't even remember if they have the right to do so if they are not mandated to that effect by an investigating judge.

But they obviously won't do so in your case.
