Hello, we just published a photo of my 4-month-old daughter on social media without my or her father's consent... can I file a complaint for violation of a minor's privacy?

      In certain circumstances, the consent of the represented person may be presumed. Three situations of this type are generally identified: photos taken in public places, photos of a crowd, and photos of public figures.

      In the case of people appearing in a photo of a monument taken in a public place, the consent of each of these people is not required when the photo is subsequently disseminated. The same applies when you photograph a crowd of people at an event.

      However, when a person appears in close-up in a photo, they can invoke their right to their image even if the photo in question was taken in a public place or if the person was part of a crowd.

      So I have the right to file a complaint? .. it’s a photo that I took but never published and it’s my husband’s ex-wife who just published it... she wants to harm my image and that of my daughter.

    Hello,

    And before going to file a complaint, why not ask the person who took the photo for its removal? It must be someone close to photograph your 4-month-old daughter and to follow her on social media.

    It’s a person who wants to harm my image and that of my daughter; she is not a close person, she is the ex-wife of my child's father.
