Hello everyone,
I want to share my unfortunate experience following an order for a suitcase from the brand CHATTAWAK on the SHOWROOMPRIVE site and see if you have any solutions for recourse against them!
I ordered a set of three suitcases (one large, one medium, one small) from SHOWROOMPRIVE of the brand CHATTAWAK on September 27, 2016, for my honeymoon, but I was wrong to trust them.
The price should have raised a red flag for me; I thought I was getting a good deal: €139 (+€18.90 shipping) instead of €699, but when I opened the box on October 14, an awful plastic smell was coming from the suitcases, and they felt particularly lightweight. Even then, I realized the quality was not there; that said, I didn't return them for two reasons: my imminent trip on October 31, so no time to buy them at such a good price, and I thought the smell would go away...
This will be the only trip they make! Upon returning from the trip, I can't tell you the condition of the suitcases, which were used under perfectly normal conditions for suitcases that should, by definition, be somewhat sturdy: the hard, shiny dark brown plastic suitcases were completely scratched, one of the suitcases has the cardboard sticking out at the seam of the zipper, and especially the corners of the suitcases were deformed, turned pink from the work the plastic had endured!!!
The lack of conformity is obvious, right? What do you think? Do you have any ideas for recourse?
This order is a real SCAM! Beware everyone, only order from brands you know well and products normally made by those brands!
I am a good customer, but I've already been burned on this site for other orders on defective items, but this time it's the last straw!
On the VENTE PRIVEE site, however, I've never had any issues for years; the quality is there!

I don't know this 'brand' CHATTAWAK.. Is it known for its 'quality'?
If you're sure you received a counterfeit (recurring issue..), it is advisable to report it to the DDPP 93 (And possibly to Customs..).
Otherwise, there is a clear lack of conformity.
Consumer Code L217-5:
The good is compliant with the contract:
1° If it is suitable for the expected use of a similar good and, if applicable:...
Of course, one could argue that you have abused the bags. The burden of proof for this assertion falls on the seller..
See the terms of the Legal Guarantee of Conformity Consumer Code L 217-4 to L 217-14. Act by registered letter with acknowledgment of receipt in the form of a formal notice.
The return is solely the seller's responsibility (But a return could erase any potential evidence of 'copy'..).
Our crystal ball predicts that starting this Monday a Mediator will emerge from nowhere to smother the issue:
'we do not sell counterfeits because it is illegal and we carefully check our suppliers, I’m sorry blablabla'
Don't let yourself be fooled!

Reminder: this site is supposed to sell quality branded items at rock-bottom prices, so my suitcases should have matched the initial selling price of €699! That's why I call it a scam!

Hello Afrikarnak,
You are right, but where it is biased on their part is that they stick a big brand name like Chattawak, a high-end clothing brand, on items that have nothing to do with it since this brand presumably does not manufacture suitcases!
I don't understand why the Chattawak brand doesn't take action against them since it damages their image. -

Using a brand name without its authorization constitutes a violation of intellectual property rights and is a constitutive element of 'infringement'..
Furthermore, there is 'deceptive commercial practice' if the name is used illegally:
C.Conso L 121-2
A commercial practice is deceptive if it is committed in any of the following circumstances:
1° When it creates confusion with another good or service, a trademark, a trade name, or another distinctive sign of a competitor;.........................
Penalty: C.Conso L 132-2: maximum fine of €300k..
