Hello,

I have a smart TV that I bought two weeks ago! Big black marks have appeared on the screen! The screen is unusable for watching movies or playing on the console.
I took it back to the store and they said it would be a problem with the panel and it isn't covered by the warranty! I really feel let down! It’s a smart TV!
The salesperson informed me that a motherboard failure could fix the issue!
Do you know how I could create a motherboard failure? Because losing 1200€ in two weeks really hurts, especially since I had saved up for a while!

A new device broken and not covered by warranty? That's something!

I highly recommend that instead of trying to fix a "problem" that is likely to be detected as fraudulent by the technicians, you post your issue on http://droit-finances.commentcamarche.net/ where you're more likely to get an appropriate response.

I advise you... not to listen to this salesperson, firstly because he is suggesting you do something that is contrary to the interests of his company, assuming that their refusal to honor the warranty is defensible, and secondly because he is advising you to do something illegal, which he will not hesitate, given his apparent level of honesty, to use against you in case of a legal procedure.

In large retail chains, it is customary and indicated in the general terms of sale or on the receipt, to detail the scope and conditions of the warranty. These provisions are mandatory, and regardless of the size of the company, their absence puts you in a position of strength in case of a dispute. It is this document, and its interpretation, that holds validity. Make sure you have it.

Furthermore, do not settle for words, which have no value. Start by reading this warranty, even if it means getting help if possible from someone with legal expertise or experience in handling commercial disputes (it doesn’t have to be a professional; it could be a regular person who has successfully claimed a refund for their oranges at a supermarket).

You should also keep everything (packaging, foam, etc.) because in case of an exchange or refund, you will be asked for the complete product, even though you may return parts taken from the new product.

Know that only the presence of one or two dead pixels (fixed points appearing in red or white) releases the seller from an exchange, and still, most accept exchanges since they themselves can request one from their supplier, but it is not your place to suggest this to them. Stick to your rights as a customer.

Prepare a letter addressed to the store manager, with a copy to the chain's management, both sent by registered mail with acknowledgment of receipt, explaining factually the problems encountered and the responses provided, specifying the dates of your visits.

Do not use threatening language, but simply state that you are requesting a response in the form of an exchange or refund within a two-week period, indicating that you are sending a copy of the letter to the consumer association in your department as well as to the local judge and to the president of the commercial court. You will obviously have to follow through on this, at least for the first two.

Do not accept any dilatory proposals for a meeting or handling by customer service, knowing that the bad faith of your interlocutors, based on the comments you report, leads me to believe that they are capable of stalling and later claiming that you missed the deadline to file your complaint.

It would also be good for you to let us know the brand and name of the chain so we can assess whether you are not a victim of a local petty tyrant as this is the first time I have seen a salesperson present arguments so contrary to the law.

for a TV that has spots on the screen; there are only two possible cases
1. problem with the panel and it is covered by the warranty.
2. impact on the screen and there, no warranty. and the repair will cost the price of a new one.
if you send attached photos of the screen with the spots
we can tell you if it's case 1 or 2.
