Issue with EOS Credirec

Hello everyone!
1- At the end of January, I received 4 Telegram Letters from Credirec asking me to contact them
by phone at 05 59 98 98 27 regarding a matter concerning me, with only 2 numbers as file references.

2- At the bottom of these letters, it is stated that they refer to formal notices dated 21/22/26 and 27 December 2016, according to article R124-4 of the civil execution procedures code WHICH I HAVE NEVER RECEIVED

3- Today, I received 4 new letters that are more detailed, UNPAID BALANCE REMINDERS, informing me of the origin of the files EOS mandated by S2P for the recovery of the referenced file, without any further details relating to any conviction or enforcement title!
There was no court decision attached to the letters, and they were regular (not recommended) letters!

4- I was therefore able to identify these debts!
It concerns a conviction (in my possession) established by the Lyon District Court on 17 December 2002 concerning 4 loan contracts that I was unable to continue repaying!!!

5- Since the date of the conviction on 17/12/2002 until today, NO ONE has ever contacted me to ask me to repay these 4 debts subject to the conviction!
That is, for 14 years!!!
And of course, during these 14 years, the contractual interests have continued to accrue!

Therefore, it cannot be considered that I refused to pay since I was never solicited by a bailiff or any debt collection agency during these 14 years!

Since this EOS Credirec company enjoys such unpopularity, I would like to have comments and advice regarding my file!

Thank you in advance,
Best regards to all,

The court decision with a validity of 30 years (before 2008) made the title enforceable until 2032; since June 2008, this period has been reduced to 10 years, making it enforceable until June 2018. Interest exceeding 5 years is subject to prescription.

Further discussion on the link provided above if necessary.

    Hello
As for me, the company eos credirec hired a bailiff for a small debt from 1997 that it bought from cofinoga, and my bank account was seized in early January 2017 (thankfully, it was very low on funds) and I can tell you that I never received any reminder letter during all these years. However, there is indeed an enforceable title (an injunctive order served at the time at the town hall as confirmed to me by the Villeurbanne court). I therefore opposed the order (registered letter to the court registry) which can be done when the first enforcement measure is put in place (bank seizure for me), even 20 years later. I have a hearing at the district court very soon (no lawyer needed) so that the judge can examine all of this because obviously, with interest, procedure costs and more, it turns out that the small debt has more than tripled!! All this to tell you to remain cautious because this company eos credirec and surely others are ready to do anything (helped by some bailiffs willing to do the dirty work!) to collect a few euros (this is the trend of recovering old debts by forced enforcement measures according to the court). I hope my testimony has helped you a bit.

      Hello fl65
I have the same issue as you, bank entry for a debt from 2007, enforcement order from 2009 and the amount has tripled. What was the result of your court hearing? I also plan to file an opposition.
      Thank you
