Hello,
I went to the Douai fair, more specifically to a shooting stand named "Le kiff, coupé, c'est gagné".
I spent a significant amount of money on a Beats pill speaker, the string broke so I received a box that the vendor said contained "a Beats pill speaker worth 200€". Throughout the evening, he kept saying "and there's someone leaving with a Beats pill speaker".
Unfortunately, when I got home, I realized that the speaker looked like a Beats pill but wasn't one; I researched the product in question, and it turned out to be a Fivestar Bluetooth speaker styled as Beats F-808 (valued at €12.99 on Cdiscount.com =

while I was supposed to win a Beats pill speaker worth €150 (in stores). The Fivestar speaker was indeed in a Beats pill box that had already been opened, but I thought he was acting in good faith and therefore only opened it when I got home. (In any case, it harms the brand; if people use it thinking it's a Beats pill while the characteristics are different, only the shape is identical).
What can I do? Is there an oral contract established with the vendor at the time of payment or not? Is it an abuse on his part? If no agreement is possible with the vendor, can I, in the worst case, file a complaint?
What are my rights?
