Is a butcher's knife "legal"? Yes, but you are not allowed to slice your neighbors with it, that's illegal...
Is a car illegal? No, but you are not allowed to run over elderly people with it, that's illegal...
Are downloading software illegal? No, unless you use it to download works protected by copyrights.
