Hello,

The judgment of Solomon regarding who is responsible for the situation is astonishing: only 4 targeted operators executed the court decision they were required to comply with because only these 4 operators were summoned to the proceedings by the claimants, and these operators have curiously contested in their defense the freedom that, to their hearing, should be granted to them for such dissemination.

The judicial tribunal of Paris unequivocally reported the demonstration of the infringing nature of the site in question.

The technical measures that have been implemented in this regard are of course easily circumventable.

Everyone does what they want, but it seemed to me that CCM took a stand against piracy, which includes publishing these circumventions.

I have nothing for or against, it's simply good to know: everyone will henceforth be justified in publishing any other infringing information based on CCM.

Hello;

You can request the removal of the publication on CCM if it seems illegitimate to you (Web + Newsletter).

Or discuss it in the Bugs and Suggestions forum, which is quite common.

Or contact the author of the publication.

Hello,

It doesn't seem illegitimate to me; it is to promote circumventing copyright, and the same author had already raised a backlash, including from memory among the moderators, for having written in the same vein:

https://www.commentcamarche.net/applis-sites/services-en-ligne/27515-telechargement-direct-les-bonnes-adresses-des-sites-pirates-en-2023/

Once again, I personally don't care; I merely expressed my surprise at the existence of a double standard that could call into question the moderators' decisions in this area.

Good evening,

Regarding the website in question, the Paris Judicial Court has indeed ruled that it is inherently infringing, but we are, despite what some may claim, in a state of law: it could only block the 4 operators that were summoned by the rights holders.

The Court therefore could not rule that it is prohibited to connect to it through other means, although it was still deemed infringing; everyone does what they want, but the act of a publication informing about these means consequently advocates for infringement.

There is indeed an ambiguity concerning not such a site, but such a protocol (torrent) which is also used depending on what people upload and where to exchange files or software that are not contestable.

Hello,

Turning a falsehood into a "tip" won't change its nature, nor the argument that the forum and the news are different entities with different responsibilities when they are, as clearly stated in "Who we are," merely parts of the same site, whose responsibility, if sought, belongs to the same publisher; it is also a legal error, this responsibility lies with the publisher, not with any author or moderator.

I concede that information about a certain site or protocol that may have a vague role is also vague, but in this specific case, the rights holders would be justified in relying on the court's ruling as case law, as it follows from this ruling that it is the entirety of the site that is infringing, not just a part of its content, with the responsibility of its publishers to remove them.
